The Hungarian electronic firm registry system

In Hungary registry courts maintain the registry of companies. In these courts, lawyers represent companies, and lawyers are also needed for founding them. Registry courts also communicate with other organizations (e.g. the Hungarian Tax and Financial Control Administration, banks, etc.).

The electronic firm registry system for legal representatives of companies

From September 2005, lawyers are allowed to submit documents to the registry courts with qualified electronic signatures. For instance, a lawyer can found a company on behalf his or her client without being physically present at a registry court. The lawyer has to submit an e-dossier to the registry court by e-mail, containing

The above e-dossier is submitted to the Ministry of Justice Firm Registry Service, who sends a receipt to the lawyer immediately (by e-mail). This receipt contains the hash of the submitted e-dossier, and is signed with the advanced electronic signature of the Firm Registry Service. (In Hungary, automated electronic signatures cannot be qualified ones.) Thus, the lawyer can prove what exactly was submitted to the Firm Registry Service.

The Firm Registry Service forwards the submitted dossier to a judge at a registry court, who makes an official decision concerning the firm. This official decision is signed with the qualified signature of the judge, and send back to the lawyer by e-mail. This signed official decision is the proof claiming that the company exists, in many cases it exists in an electronically signed form only.

Communications between these organizations is based on (mostly advanced) electronic signatures. Messages are created and processed by automatic mechanisms (except of the case of some smaller financial institutions).
